1. Acceptance of Terms

By accessing or using BoxxKandiTM Software Studio's website and software products, or by purchasing BoxxKandiTM Software, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase the Software.

2. Products & Services

BoxxKandiTM Software Studio provides digital software products, including BoomRexTM, intended for audio processing in streaming, broadcasting, and production environments. All products are delivered digitally.

3. Purchases & Payments

When you purchase our software, you agree to:

  • Provide accurate information (email required)
  • Pay all applicable fees associated with your purchase
  • Receive your license key via email

You are responsible for ensuring your email address is correct. All prices are in US dollars unless otherwise specified, and prices are subject to change with notice.

4. License & Usage

All purchases are subject to the End User License Agreement (EULA). Subject to your compliance with these Terms, BoxxKandiTM grants you a limited, non-exclusive, non-transferable license to use the Software. This license grants usage rights only—ownership remains with BoxxKandiTM.

  • Download and install our software on your personal devices
  • Use the software for personal or commercial purposes as licensed
  • Create backup copies of the software for archival purposes

Licenses are:

  • Non-transferable
  • Non-shareable
  • Limited to one user or one company

5. License Activation

An internet connection is required to activate and validate your license. Failure to activate may result in limited functionality.

6. Refund Policy

Refunds are governed by our Refund Policy. We offer a 14-day no-questions-asked refund period from the date of purchase.

7. Prohibited Conduct

You agree NOT to:

  • Copy, modify, or distribute the software except as permitted
  • Reverse engineer, decompile, or disassemble the software
  • Rent, lease, or lend the software to third parties
  • Remove any proprietary notices from the software
  • Use the software for any unlawful purpose
  • Share or resell license keys
  • Attempt to bypass licensing systems

Violation may result in immediate license termination.

8. License Enforcement

We reserve the right to:

  • Monitor license usage
  • Investigate suspected abuse
  • Revoke licenses if abuse, sharing, or fraud is detected

9. Early Access Disclaimer

BoomRexTM is an early access product (v1.0.0). It may contain bugs, incomplete features, or unexpected behavior.

10. Website Soundboard Demo — Free Use Terms

10.1 Nature of the App

BoxxKandiTM Software Studio provides a free, browser-based Radio Jingle Pad soundboard application embedded on our website ("the Soundboard App"). This Soundboard App is provided solely as a demonstration and preview of our software capabilities and is intended to allow users to experience the concept and functionality of our Jingle Pad product directly in their browser. The Soundboard App is not a standalone product and is not a substitute for the full desktop application.

10.2 Permitted Use

You may use the Soundboard App for both personal and commercial purposes. This includes, but is not limited to:

  • Personal entertainment and experimentation
  • Live radio streaming and broadcasting
  • Podcast production and recording
  • Online content creation (YouTube, Twitch, social media, etc.)
  • Live events, DJ sets, and public performances
  • Any other personal or commercial audio production purpose

10.3 Restrictions on the App

The following restrictions apply specifically to the Soundboard App:

  • The Soundboard App is provided free of charge and may not be sold, resold, hired out, leased, or rented to any third party under any circumstances
  • You may not charge others for access to the Soundboard App or incorporate it into a paid product or service without express written permission from BoxxKandiTM Software Studio
  • You may not redistribute the Soundboard App, host it on your own servers, or embed it on external websites without prior written authorization
  • You may not modify, reverse engineer, or create derivative works from the Soundboard App
  • You may not remove, alter, or obscure any BoxxKandiTM branding, logos, watermarks, or attribution from the Soundboard App
  • The Soundboard App is intended for use directly on the BoxxKandiTM website only

10.4 Included Sound Effects & Audio Content

The Soundboard App comes pre-loaded with a selection of sound effects and audio files ("Included Sounds"). These Included Sounds are sourced from Freesound.org, a collaborative database of Creative Commons licensed sounds, and are believed to be released under the Creative Commons Zero (CC0) license, which places the sounds in the public domain.

Important — Please read the following carefully regarding the Included Sounds:

  • The Included Sounds are provided purely as a demonstration of what the Soundboard App can do. You are in no way obligated or required to use them
  • BoxxKandiTM Software Studio makes no guarantee, representation, or warranty as to the accuracy, validity, or legitimacy of the CC0 license status of any Included Sound
  • While every reasonable effort has been made to source sounds that are properly licensed, we cannot independently verify the licensing claims of every individual uploader on Freesound.org
  • The use of any Included Sound is entirely at your own discretion and risk. You accept full responsibility for any consequences arising from your use of these sounds in any context
  • You may use the Included Sounds for personal or commercial purposes, including but not limited to radio broadcasts, podcasts, live streams, and content creation, but you do so entirely at your own risk
  • BoxxKandiTM Software Studio shall not be held liable for any copyright infringement claims, legal disputes, or damages arising from your use of the Included Sounds
  • You are encouraged to conduct your own due diligence on any sound before using it in a commercial or public setting. You may visit Freesound.org's Terms of Service for more information about their licensing and usage policies

10.5 User-Loaded Audio Content

The Soundboard App allows you to load your own audio files. You acknowledge and agree that:

  • You are solely responsible for ensuring that any audio files you load into the Soundboard App do not infringe upon the intellectual property rights of any third party
  • BoxxKandiTM Software Studio has no control over, and accepts no liability for, any audio content uploaded or loaded by users
  • All audio data loaded into the Soundboard App is stored locally in your browser (using IndexedDB and localStorage) and is not transmitted to or stored on BoxxKandiTM's servers

10.6 No Warranty on Soundboard App

The Soundboard App is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. BoxxKandiTM Software Studio does not warrant that:

  • The Soundboard App will be available at all times or uninterrupted
  • The Soundboard App will be error-free or free from bugs
  • Any sounds or content included will meet your specific requirements
  • The licensing status of any Included Sound is accurate or up to date

10.7 Modifications & Availability

BoxxKandiTM Software Studio reserves the right to modify, update, suspend, or discontinue the Soundboard App or any portion thereof at any time, with or without notice. We also reserve the right to add, remove, or replace Included Sounds at any time without prior notice. Continued use of the Soundboard App following any such changes constitutes your acceptance of those changes.

11. Intellectual Property

All BoxxKandiTM software, documentation, and related materials are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved by BoxxKandiTM Software Studio.

12. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not guarantee:

  • Error-free operation
  • Compatibility with all systems
  • Continuous uptime

13. Limitation of Liability

IN NO EVENT SHALL BOXXKANDITM SOFTWARE STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, THE SOUNDBOARD APP, OR ANY INCLUDED SOUNDS.

To the fullest extent permitted by law, BoxxKandiTM shall not be liable for:

  • Data loss
  • Hardware/software damage
  • Loss of profits or business
  • Any indirect or consequential damages
  • Any claims arising from the use of Included Sounds, including but not limited to copyright infringement claims

Liability is limited to the amount paid.

14. Privacy

Use of this website is also governed by our Privacy Policy.

15. Termination

We may terminate or suspend your access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. This Agreement terminates automatically if you violate any terms.

Upon termination, you must cease all use and delete all copies of the Software.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of South Africa.
